Bicycle Accident Compensation – Claims Studies

Here are just a few examples of how compensation was claimed by cyclists who were involved in a cycle accident.

1. In February 2006 a man was cycling along a road in south London when a car pulled out from a T-junction and knocked him off his bicycle. The driver had not been paying attention to the road and as a result the cyclist suffered a broken hip as well as cuts and bruises to his head and body. After collecting the driver’s information and seeking legal help, he was awarded £5,500 in compensation for his bike accident.

2. A teenager who was hit by a car side-on at a zebra crossing was able to secure a £30,000 compensation payout. He suffered head and leg injuries in the accident and was rushed to hospital. He had to undergo surgery to his leg as he suffered compound fractures to his fibula and tibia. His solicitors secured him bike accident compensation after the driver of the car admitted liability.

3. A cyclist who was thrown from his bicycle after the front wheel hit a pothole in the road was awarded £7,600 in compensation. After hitting the pothole he had lost grip of the handlebars and suffered broken ribs, a dislocated shoulder and other hip and knee injuries. He was awarded bike accident compensation after his lawyers filed a claim against his local council who are responsible for maintaining road surfaces.

4. A man who was cycling to work was hit by a heavy goods vehicle that drove out of a minor road straight into his path. He sustained serious head injuries in the collision as well as injuries to his arms and back, serious internal injuries and several fractures. In court it was heard that the driver of the HGV was talking on his mobile at the time of the accident and had failed to notice the cyclist. As a result of his injuries and the prolonged length of recovery time he was awarded £350,000 compensation.

5. A cyclist travelling on his way home came across a set of traffic lights on red at a crossroads and immediately stopped. When the lights changed to green he set off again into the junction, but a lorry driver that was coming from the right drove through the red light and drove his vehicle straight across the junction and collided into the cyclist. He sustained serious injuries in the bike accident, including fractures to his arm and leg. He was unable to work for two months and sued the driver of the lorry for compensation. He was awarded £23,600 compensation after the lorry driver admitted liability.

6. A man whose bicycle skidded on ice as he arrived at his workplace, throwing him to the ground, filed a successful claim for compensation from his employers. He sustained a fractured pelvis and severe soft tissue damage to his shoulder. The cyclist had to remain in hospital for nearly five weeks and required extensive treatment. The injured cyclist believed that his employer was partly responsible for the injuries he sustained as the ground has not been gritted and there was insufficient lighting for the time of day. He was awarded £35,000 for the injuries sustained and for the cost of any further medical treatment he may require.

7. A 65 year old man was awarded compensation after a dog ran under the wheel of his bike. He was cycling through a park when a dog that was not on its lead run in front of his bike, throwing him over the handlebars. The cyclist sustained a fractured pelvis and was unable to walk unaided for three months and could not return to work for a further six months. The owner of the dog was liable for the dog’s actions as it should have been on a lead and was sued for bike accident compensation. The man was awarded £14,000 for his injuries..

pic_158. A cyclist who was knocked from his bicycle by a motorcyclist attempting to overtake him has claimed compensation for his bike accident. He sustained very severe injuries in the accident and claimed compensation from the motorcyclist who was responsible for the crash as he was travelling over the speed limit and undertaking the manoeuvre with little space. The insurance company argued that the cyclist was 25 per cent responsible for his injuries as he was not wearing a safety helmet. However, a court ruled that it is not compulsory for a cyclist to wear a safety helmet and the motorcyclist was therefore 100 per cent liable. The cyclist was awarded £10,000 compensation for his injuries.

9. A cyclist on a training ride who was knocked from his bicycle received compensation. The man was cycling along a road when a motorist suddenly turned right across the carriageway into collided with his bicycle. He suffered a dislocated index finger and soft tissue injuries to his shoulder and knee. He lost ten weeks of training as a result of his injuries, which had a significant effect on his fitness levels. The driver of the car admitted liability and he was awarded £6,000 for his injuries, property damage, loss of leisure time, care and assistance and other consequential losses and expenses.

10. A couple were cycling along a busy road in Hampshire when they approached a junction. A motorist suddenly pulled out of the junction across their path. They were both knocked from their bikes and sustained minor injuries and damage to their bicycles. The insurers of the driver admitted liability and they were both awarded £1,500 for their losses as a result of the bike accident.
